General Terms and Conditions (GTC)

Leimer Hospitality Consulting (SWISS Beauty Travel brand)

Scope of application & contracting parties

 

These GTC apply to all brokerage and consulting services provided by Leimer Hospitality Consulting to private customers resident in Switzerland.

1.2 The contractual partners are the intermediary (Leimer Hospitality Consulting, owner:

Valentina Leimer, Zugerstrasse 32, CH-6032 Baar) and the customer.

 

Definitions

‘Treatment’ includes all medical-aesthetic services (e.g. breast surgery, dental treatment, hair transplantation, liposuction, rhinoplasty, facelift, Botox, filler).

‘Clinic contract’ refers to the contract directly between the customer and the clinic.

 

Conclusion of contract

The customer submits their offer via the online form.

The contract is concluded upon receipt of the booking confirmation by e-mail (§ 11 OR).

The written form requirement is met by e-mail.

 

Scope of services provided by the intermediary

Comprehensive risk and cost clarification by telephone, video call or e-mail

Coordination of treatment appointment, transfer, accommodation and - on request - interpreter

Dispatch of all relevant documents in German and English

After-care service for 30 days after return (e-mail/telephone)

Arrangement of cooperating doctors in Switzerland for follow-up treatment

Customer's duty to cooperate

- Complete and truthful information on state of health, allergies and previous illnesses

(§ 97 KVG)

- Obtain a second medical opinion before booking

- Take out travel, health and repatriation insurance before departure

- Comply with all medical instructions and clinic guidelines

 

Prices & payment

All prices in CHF incl. VAT.

Payments are made directly to the respective clinic or third-party provider in accordance with their terms and conditions

No advance payments to the agent are required

The agent's commission is already included in the clinic price

 

Cancellation & rebooking

Voluntary right of withdrawal: 7 days from booking confirmation (in writing by e-mail)

Cancellation costs: CHF 180 administration fee + non-refundable third-party service costs

Rebooking up to 60 days before the date: Processing fee CHF 100 plus any additional costs

From 30 days before the date, no right to rebook; cancellation without refund

 

Limitation of liability

The agent is only liable in cases of intent or gross negligence (§ 100 OR).

Slight negligence is excluded to the extent permitted by law.

No liability for medical risks, complications, scars, allergies or successful treatment.

No liability for travel and luggage disruptions or changes to clinic appointments.

Maximum liability: CHF 10,000 per claim.

Warranty & support

Claims for defects are directed exclusively against the clinic.

The agent shall support the enforcement of claims in good faith.

Warranty period: 2 years analogous to consumer goods liability.

 

Indemnification

The customer indemnifies the agent against all third-party claims resulting from incorrect or incomplete information.

Including assumption of all resulting legal and court costs.

 

Confidentiality & data protection

Both parties undertake not to disclose confidential information to third parties

without authorisation (§ 321 OR).

Data protection is in accordance with the Swiss Data Protection Act and GDPR (Art. 13 ff.).

Disclosure of customer data only to clinics and service providers with an appropriate level of data protection.

Storage of personal data for 10 years (§ 957 ff. OR).

 

Force majeure

In the event of force majeure (e.g. natural disasters, political unrest, pandemics), the obligation of both parties to perform is cancelled (§ 119 OR analogously).

Any additional costs incurred for rebookings or extended stays shall be borne by the customer, unless otherwise agreed.

Amendments to the GTC

The Agent may amend these GTC and shall announce amendments by email 4 weeks before they come into force.

If the customer does not object within 14 days, the changes shall be deemed accepted.

 

Communication & documentation

Agreements must be made in writing; e-mail is sufficient.

Consultations are recorded and made available to the customer.

 

Quality assurance

Regular review of clinic certifications (e.g. JCI, ISO).

Customer satisfaction is systematically recorded; negative feedback leads to review and improvement measures.

 

Complaints management

Complaints must be submitted in writing to info@swissbeautytravel.ch.

The internal arbitration centre will endeavour to find a solution within 14 days.

 

Insurance

The agent maintains professional liability insurance with cover of at least CHF 1 million.

The customer must take out their own travel, health and repatriation insurance and provide proof of this before booking.

 

Licence & accreditation check

The agent continuously checks all clinics for valid operating licences and medical qualifications.

Payment guarantees

On request, the clinic will provide a payment guarantee via a Swiss bank or an escrow account.

In the event of late payment, the clinic reserves the right to suspend services.

 

Brand and name usage

The brand name ‘SWISS Beauty Travel’ may only be used with the written consent of the agent.

The agent reserves the right to claim damages in the event of infringements.

 

Compliance & regulation

The agent complies with all relevant Swiss laws (OR, UWG, KKG, TKG, DSG).

Regular compliance training for employees and partners is guaranteed.

 

Statute of limitations

Claims arising from this contract expire after 5 years (§ 127 OR).

Tort claims expire after 10 years (§ 60 OR).

 

Place of jurisdiction & applicable law

Swiss law applies exclusively.

The exclusive place of jurisdiction is Zurich, Switzerland (insofar as legally permissible).

The UN Convention on Contracts for the International Sale of Goods is excluded.

 

Severability clause

Should individual provisions of these GTC be invalid, this shall not affect the validity of the remaining provisions.

The ineffective clause shall be replaced by one that comes closest to the economic purpose.​​​
